Abstract

There are a number of provisions in the JCT 2016 contracts that govern the contractor's entitlement to loss and/or expense. Once the contractor decides to trigger the loss and expense clause, it imposes specific obligations not only on the contractor but also on the employer or his representative, which is not something that they always fully appreciate. There is no connection between extensions of time/relevant events and loss and expense/relevant matters other than that some of the grounds for extending time are echoed in the grounds for claiming loss and expense. The JCT 20106 contracts do not provide any set format for the contractor's application, so it is left to the contractor to devise a format to suit itself. The JCT 2016 contracts all state that the contractor shall comply with the contract's relevant notification and assessment clauses.
