Abstract

This chapter shows the JCT 2016 Sub-Contracts and their corresponding JCT 2016 main contracts. The NEC4 Sub-contract is for use where a sub-contractor is engaged by the main contractor, whom the Client has appointed under one of the NEC4 main contracts. The chapter covers the variations under the JCT 2016 Sub-Contracts. In keeping with the NEC ethos, the NEC4 Sub-contract and Short Sub-contract each operate a ‘compensation event’ procedure. Extensions of time are dealt with by the dedicated clauses in the JCT 2016 Sub-Contracts. The Relevant Sub-Contract Matters that entitle a sub-contractor to loss and expense are very similar in nature to the ‘Relevant Events’ that provide the same entitlement for the main contractor under the corresponding JCT 2016 main contracts.
