Abstract

Modern building contracts require the administrative and valuation functions to be carried out by someone acting on the employer's behalf. The employer's representative's duties mainly focus on administering the building contract between the employer and the contractor. The first aspect concerns the duties that the employer's representative should be expected to perform for the employer, and are likely to include the management of other consultants, and reporting cost, quality and programme matters to the employer. In any event, the employer's representative's duties to the employer should not materially or directly affect the contractor, as his duties under the terms of the building contract will be clear. The second aspect concerns the employer's representative's duties under the building contract, so the contractor will have a much greater idea of the extent of the duties owed to him.
