Abstract

This chapter offers a critical examination of the legal framework surrounding contingent protection measures in global trade. It does not aim to provide an exhaustive doctrinal analysis of trade remedy rules or a comprehensive review of the literature on trade and contingent protection. It first outlines the legal frameworks of contingent trade-protective measures as specified in relevant WTO rules, which are central to this research. This sets the conceptual and institutional groundwork for readers to grasp the concepts, principles, and rules of various trade remedy regimes. The chapter then explores the fundamental rationales behind these contingent protection tools in international trade law, concluding with some forward-looking insights.
