Abstract

Abstract: Currently, there is a growing number of lawsuits from patients, primarily those with Biocell breast implants, against the surgeons who performed the procedures. This is partly due to law firms actively seeking out affected individuals to pursue claims for damages based on allegedly inadequate disclosure of the risk of BIA-ALCL. The unsuccessful attempts to obtain financial compensation through product liability and proof of a defective medical device may also contribute to this trend. This raises the question of when a surgeon could reasonably be expected to disclose the associated risks.
