The Sale of Goods
Abstract
Abstract This book deals with the law of sale of goods as applied by English courts to contracts governed by English law. It deals with the relationship between statute (the Sale of Goods Act 1979) and the underlying common law, also with the relationship between contract and property law. Performance issues such as delivery and payment are addressed as well as the implied terms of satisfactory quality and fitness for purpose, together with attempts to exclude and limit liability. Breach of contract and remedies, such as the seller’s real remedies, the price action, specific performance, and damages, are also dealt with in this text. Updates to the fifth edition include discussions of the rights of consumers in an increasingly digital era with the Digital Markets, Competition and Consumers Act 2024 and the Electronic Documents Act 2023, and examinations of recent cases such as Gregor Fisken v Carl, Natixis SA v Marex Financial, and Bates v Post Office.
