Abstract

Abstract The general principle of freedom of contract can be regarded as a fundamental principle of EU law. This book examines the interplay between freedom of contract, on the one hand, and the protection of the weaker party and the promotion of (other) public interests, on the other, and how this impacts banks and other financial institutions. After all, they too are entitled to rely on freedom of contract as a basic principle. The various restrictions on the freedom of contract of financial institutions are reviewed in this book on the basis of the following three criteria: legitimacy, proportionality, and consistency.
