Concluding Remarks
Abstract
Abstract Whether or not we regard restrictions on the freedom of contract of financial institutions (and their counterparties) as legitimate, proportionate, and consistent, there is an unmistakable trend towards increasing restrictions on the freedom of contract of financial institutions, and of banks in particular. Added to which, other types of financial institution are usually dragged along in the wake of the banks. These increasing restrictions on freedom of contract are not only for the sake of protecting the weaker party, but also for other reasons, such as human rights and sustainability thinking.
