Abstract

Abstract This chapter deals with director disqualification sanctions and their introduction into UK law under Sanctions and Anti-Money Laundering Act 2018 by the Economic Crime and Corporate Transparency Act 2023 (ECCTA). It sets out the background and definitions provided by the Company Directors Disqualification Act 1986 (CDDA) before considering the impact of and the reasons behind its extension into the UK’s sanctions framework. The reasons for imposing a director disqualification on a designated person and the impact of disqualification on such a person are also analysed. The penalties for breach of a disqualification are considered as well as the extension of liability to secondary persons, that of companies, and their officers. Exceptions, jurisdictional reach, and the ambit of sanctions regimes currently including this power are discussed. A useful comparison is made with the impact of the trust services ban.
