Abstract

This chapter explores the complex legal and ethical landscape surrounding blockchain adoption, with a particular focus on cryptoassets, decentralised governance, and algorithmic accountability. It introduces the “Panopticon effect” as a conceptual lens for understanding how blockchain enforces compliance and transparency through decentralised, immutable data structures. While this reduces reliance on traditional enforcement mechanisms, it also raises concerns about surveillance, consent, and autonomy – particularly as blockchain converges with AI and predictive systems . The chapter offers a comparative analysis of cryptoasset regulation across the UK, US, Japan, China, and the European Union, revealing a fragmented global landscape. Jurisdictions differ significantly: the UK and Japan favour integration into existing financial frameworks; the US remains divided between multiple federal agencies; China enforces a sweeping ban; and the EU seeks harmonisation through its MiCA regulation. Internationally, the Financial Action Task Force (FATF) provides key AML/CTF standards, while nations like Switzerland and Singapore lead in balanced, innovation-friendly regulation . The chapter concludes by arguing for a harmonised yet adaptive approach to blockchain governance—one that protects consumers, enables innovation, and remains alert to ethical risks. In construction and beyond, the design of digital legal infrastructures must be grounded in normative reflection as much as technical capability .
