Abstract

Federal and state agencies, Indian tribes, hydropower developers, and public interest groups each have a different perspective on the role of balancing in hydropower licensing. The balancing of developmental and non-developmental values is inherent in the states’ water allocation policies and Federal Energy Regulatory Commission’s (FERC) licensing decisions. The role of balancing in the state and FERC ‘s decision making is changing. This is one of the most significant areas of potential overlap and conflict between the states and the FERC.
