Abstract

This chapter discusses feminist refusal as a methodology of legal ethnographic writing about gender and sexual violence and protection. Theorizing legal fiction, the chapter discusses challenges to writing with law and the politics of claiming unsilencing, experience, and the victim as a legal subject position. The chapter engages different approaches to race and experience taken up by critical race theory, critical ethnic studies, and feminist theories, albeit in in different ways.
