Abstract

Consensualismo. ABSTRACT This article aims to analyze the role of the Judicial Centers for Conflict Resolution and Citizenship (CEJUSCs) with environmental jurisdiction as instruments for strengthening good governance within the Judiciary, through the promotion of consensual methods of conflict resolution. It is based on the premise that environmental disputes, due to their technical complexity, the multiplicity of involved parties, and collective consequences, require more dialogical, preventive, and collaborative approaches that go beyond the traditional adversarial model. The general objective is to investigate how Environmental CEJUSCs contribute to the institutional governance of the Judiciary by promoting the effectiveness of environmental protection through mediation and conciliation. To this end, the specific objectives include: examining the legal and normative foundations that support the creation and operation of CEJUSCs with an environmental focus; understanding the role of consensual methods in building sustainable and peaceful solutions for environmental conflicts; analyzing practical experiences of Environmental CEJUSCs in Brazil and their impacts on reducing litigation, improving procedural speed, and democratizing access to justice; and finally, proposing guidelines for the institutional strengthening of these centers as a public policy of the Judiciary guided by efficiency, social participation, and sustainability. The research adopts a qualitative approach, based on regulatory and bibliographic review, as well as the analysis of successful initiatives, demonstrating that environmental consensualism, when institutionalized through structures such as CEJUSCs, represents an important path for the realization of fundamental social and environmental rights and for the improvement of environmental governance in Brazil.
