Lagunas y disonancias de la legislación turística gallega:
Abstract
Despite the existence of legislation in Galicia designed to regulate the tourism sector, ensure minimum standards, and protect customers, the practical experience of tourism establishments reveals persistent gaps between regulation and their operational reality. These gaps have widened with the emergence of digitalization, automation, and artificial intelligence. This paper offers a critical comparative analysis of six areas in which Galician tourism law (Galician Tourism Act 7/2011 and Decrees 179/2011 and 57/2016) diverges from everyday hotel practice. From a legal and managerial perspective, the study identifies operational rigidities which may be corrected without undermining consumer protection by applying the principles of proportionality, functional equivalence, and technological neutrality. The objective of the analysis is to provide a constructive, forward-looking assessment of the current situation as a contribution to a future review of the regulatory framework in Galicia to bring it into line with European (and Spanish) “Better Regulation” standards and move it towards a more flexible, verifiable, and technologically neutral model.
