Abstract
The study aims to establish the foundations of an institutional da‘wah-oriented fatwa system and to work seriously toward its formulation and implementation through identifying the components, methods, and means of preparation, both theoretically and practically. It adopts the analytical method to describe and examine the reality of da‘wah-oriented and traditional fatwa practices, the inductive method to derive the administrative and scholarly frameworks for building a da‘wah-oriented fatwa system and to formulate the controls and rules governing fatwa discourse directed to new Muslims, and the comparative method to clarify points of convergence and divergence between da‘wah-oriented and traditional fatwas and to define the relationship between them. The study addresses the da‘wah-oriented fatwa system in terms of the necessity of rebuilding it according to sound principles of preparation and training, with a particular focus on new Muslims as an applied model reflecting the need for a specialized and qualified fatwa discourse. Among the findings of the study is that the da‘wah-oriented fatwa system represents a contemporary necessity rather than a mere formal extension of the traditional fatwa system, due to its complementary role in preparing and influencing the inquiring addressee prior to the articulation of the legal ruling in a given case. The study also finds that da‘wah-oriented fatwas differ from traditional fatwas in both methodology and function, as the former relies on encouragement and deterrence in accordance with the sciences of da‘wah, whereas the latter focuses on informing about legal permissibility and prohibition within the framework of the Islamic legal sciences. The study highlights the particularity of new Muslims and their need for a specialized fatwa discourse that takes into account their cultural and social differences and presents the fatwa in a persuasive and impactful manner through an understanding of the methodology of da‘wah discourse directed at them. It further affirms that the integration of da‘wah-oriented and traditional fatwas is a prerequisite for achieving clear and effective religious communication, as religious discourse cannot be properly realized without coordination between da‘wah and legislative institutions. Among the most prominent recommendations of the study is the call to establish an integrated institutional framework for da‘wah-oriented fatwas that addresses the various categories of addressees, with special attention given to new Muslims, while operating in a complementary relationship with traditional fatwa institutions rather than in isolation from them. The study also recommends developing a comprehensive training program for da‘wah-oriented muftis that combines Islamic legal sciences, principles of da‘wah, intercultural communication skills, and an understanding of the realities of da‘wah and the conditions of the addressees, and emphasizes the importance of preparing an administrative and organizational guide that regulates the institutional structure, defines responsibilities, and ensures mechanisms for monitoring and continuous evaluation. It further recommends adopting a systematic plan for producing translated da‘wah-oriented fatwa media content that addresses new Muslims in their own languages and through approaches that respect their cultural and social specificities. The study also affirms the necessity of studying the addressee and diagnosing their context prior to issuing a fatwa in order to select the most appropriate mode of presentation, launching da‘wah initiatives based on facilitative fatwas that observe the objectives of Islamic law without compromising the textual sources, thereby contributing to strengthening religious stability and commitment among new Muslims, and emphasizes the importance of enhancing institutional cooperation between scholars of da‘wah and traditional jurists to produce a balanced fatwa discourse that combines legal rulings with da‘wah-oriented guidance.
