Affirmative Action: An Applied Jurisprudential Study in Light of the Objectives of Islamic Law (Maqāṣid al-Sharīʿah)
Abstract
Abstract:Affirmative action is one of the common terms in contemporary systems and policies, raising issues because it is an act intended to favor specific groups or individuals. The research aims to establish the jurisprudential basis (Ta'seel Fiqhi) for affirmative action by clarifying its concept, ruling (Hukm), and justifications, while simultaneously setting restrictions and controls for its legitimacy. This is accomplished through an applied jurisprudential study in light of the Objectives (Maqasid) of Islamic Law. The research combines descriptive and analytical methodologies, utilizing the tools of induction, analysis, and comparison, and adhering to the necessary research steps and procedures inherent in the nature of Fiqhi research. The research is structured into an introduction, four chapters, and a conclusion. The research yielded a number of significant findings, the most important of which are: that affirmative action is not a deviation from the principle of equality but rather a form of its correct implementation; that the legitimacy of affirmative action is conditional upon established controls and recognized justifications; that affirmative action is considered one of the tools available to the Muslim Ruler/Authority (Wali al-Amr) for realizing the public interest (Maslaha) of the Ummah (nation/community). Furthermore, the research found that although affirmative action is a contemporary term, its content and meaning are present in the Islamic jurisprudential heritage. The research concludes with recommendations, including the necessity of devoting attention to the jurisprudential rooting (Ta'seel Fiqhi) of contemporary terms, and subjecting the manifestations of affirmative action in contemporary reality to Sharia controls, linking them to the universal juristic maxims (Al-Qawa'id al-Kulliyyah) and the Objectives of Sharia (Al-Maqasid al-Shar'iyyah) before implementing them in policies and legislation, and evaluating those currently in practice.
