Abstract

This research examines divorce compensation (Mutʿat al-Ṭalāq) as a Sharīʿa-based and socio-legal institution designed to console and compensate divorced women—both materially and morally—for the harm resulting from marital dissolution. It explores this principle through the dual lens of Islamic jurisprudence and Saudi family law, analyzing the tension between legislative silence and the maqāṣid al-sharīʿa (higher objectives of Islamic law). The study aims to define the concept of divorce compensation linguistically and jurisprudentially, trace its historical development across Islamic legal schools, analyze juristic opinions regarding its obligation and amount, and compare these positions with civil and family law systems in Arab, Western, and Asian jurisdictions. It further provides a critical assessment of the Saudi Personal Status Law, offering reform-oriented recommendations that balance Sharīʿa authenticity with social justice.Methodologically, the study employs the inductive approach to gather textual evidence, the analytical approach to extract legal and maqāṣid-based meanings, the comparative approach to contrast fiqh and statutory perspectives, and the historical and critical approaches to evaluate the evolution and policy implications of legislative silence.Structured across seven chapters, the research spans conceptual and historical foundations, contemporary academic developments, comparative legal analyses, and a detailed evaluation of the Saudi legal stance. The findings affirm that divorce compensation is a fundamental Qurʾānic right grounded in justice and benevolence, and that the legislative silence of Saudi law reveals a gap between the comprehensive Qurʾānic mandate and restrictive codification. The study calls for a broadened statutory recognition of divorce compensation proportionate to harm and financial capacity, thereby reinforcing equity, compassion, and the dignity of women in marital dissolution.
