Abstract

The discretionary power of the administrative judge in seeking expert assistance is a fundamental pillar for achieving justice, as it grants him the necessary flexibility to deal with complex technical matters. Although this power is broad, it is not absolute, but rather subject to legal controls and judicial oversight to ensure that it is not used arbitrarily. Hence the need for this study to clarify this power and the limitations placed upon it. The plan is structured as follows: an introduction and a preface explaining the concept of discretionary power, expertise, and the categories of experts, followed by three main sections; The first section addressed the court's discretionary power in ordering expert testimony, the second section addressed the court's discretionary power in accepting the expert's assessment, and the third section addressed the court's discretionary power in determining the expert's fees. The study concluded with several findings, including the importance of expert testimony in establishing justice and reaching a fair verdict, and that the court has the legal authority to utilize expert testimony. The study also recommended updating the rules governing expert testimony to align with evolving litigation procedures, particularly given the near-complete reliance on remote litigation. May God grant success.
