The Role of Administrative Judiciary in Collecting State Revenues: A Comparative Analytical Study
Abstract
Public revenues represent the foundation for financing government expenditures and achieving economic and social policies. Their collection ensures the smooth operation of public services and supports the goals of sustainable development. Given its importance, the Saudi legislator has codified collection procedures to balance administrative efficiency in fulfilling state rights with the guarantees of those obligated to pay. Within this framework, the administrative judiciary, represented by the Board of Grievances, has emerged as a supervisory and judicial mechanism for adjudicating collection disputes. With the development of the judicial system in light of Vision 2030, the legislator has entrusted the Board of Grievances—by virtue of its statute, the statute of civil procedure, and the statute of enforcement before it—with the authority to review enforcement requests submitted by administrative bodies concerning public financial rights. The importance of this jurisdiction increases with the expansion of the state's financial activity and the growing need to protect public funds and safeguard individual rights. The research problem centers on determining the extent of the administrative judiciary's authority to exercise executive power over revenue collection procedures: Is its role limited to judicial oversight of collection decisions and appeals, or does it extend to enforcement? The research also examines the legal framework governing this authority, its limits, and its consistency with the principle of separation of powers. It clarifies whether the administrative body can execute directly according to the State Revenue Law and its regulations, or whether it must resort to the Board of Grievances for enforcement.
