Praise be to God, Lord of the Worlds, and peace and blessings be upon the Master of all Creation, our Prophet Muhammad (peace be upon him). This research addresses the issue of dividing wealth before death, a contemporary issue that frequently arises. Some individuals distribute their wealth among their children or relatives during their lifetime, either out of a desire to achieve fairness among them, fear of disputes arising after their death, or with the intention of depriving some heirs of their legal share. This necessitates a thorough jurisprudential and legal study of this phenomenon. To clarify its ruling and impact on inheritance, this research was undertaken, establishing the foundations of the issue, outlining its various forms and legal rulings, and clarifying the positions of both Egyptian civil law and Egyptian personal status law. It is divided into an introduction, a preface, four main sections, and a conclusion, as follows: The preface defines inheritance and estate, their pillars and conditions, and distinguishes between inheritance, bequest, and gift. It also explains the meaning of dividing property before death. The first section addresses the ruling on a person's disposal of their property during health and illness. The second section focuses on the ruling regarding dividing property before death with the intention of inheritance. The third section examines the impact of this division on inheritance, the rights of heirs, and its legal validity after death. The fourth section outlines the legal and religious guidelines governing a person's disposal of their property during their lifetime. The conclusion summarizes the most important findings and recommendations of the research. This research aims to clarify the Islamic legal ruling on disposing of property before death and its resulting implications. The division of an estate, with an explanation of the position under Egyptian law, and its implications: that a division completed during one's lifetime while in good health is considered a valid and legally binding gift.
