التقنيات الحديثة وأثرها في استغلال الأطفال في الأعمال المجرمة - (دراسة فقهية مقارنة) Modern Technologies and Their Impact on the Exploitation of Children in Criminal Activities (A Comparative Jurisprudential Study)

تهدف الدراسة إلى معرفة حكم استخدام التقنيات الحديثة، وأثرها في: استغلال الأطفال في الأعمال المجرمة؛ حيث إن التقنيات الحديثة تعتبر من سمات العصر الحديث، وغالبًا ما يستخدمها الأطفال كوسيلة مسلية في حياتهم أو كوسيلة مساعدة في تعلمهم، وتثقفهم.وقد اشتمل البحث على مقدمة، وتمهيد، وأربعة مباحث، وخاتمة، والمبحث الأول في: جريمة استغلال الاطفال في صناعة مقاطع الفيديو المصورة عن طريق التيك توك، والمبحث الثاني في: جريمة استغلال الأطفال في جلب وترويج المخدرات عبر وسائل التقنية الحديثة، والمبحث الثالث في: جريمة استغلال الأطفال في المتعة الحرام عبر وسائل التقنية الحديثة، والمبحث الرابع في: جريمة استغلال الأطفال عن طريق الابتزاز الالكتروني، والخاتمة: وتضمن أهم النتائج التي توصلت اليها، وأهم التوصيات، وثبت للمصادر والمراجع.وقد توصلت من خلال هذه الدراسة إلى أن الاستخدام المفرط للتقنيات الحديثة من قبل الأطفال يساعد على استغلال الأطفال بصورة جلية، حيث إن الطفل في بداية حياته ينهل من التقنيات الحديثة بكل ما تشتمل عليه من إيجابيات عديدة وسلبيات، وربما سلبياتها أكثر، وبخاصة عند غياب الرقابة من جهة الوالدين نجد أن الأبناء مع أنهم داخل غرف مغلقة بالأبواب لكنها منفتحة على أنحاء العالم مما يشكل خطرًا كبيرًا عليهم، ووسيلة في استغلالهم، وانحرافهم. This study aims to determine the ruling on the use of modern technologies and their impact on the exploitation of children in criminal activities. Modern technologies are a hallmark of the modern age, and children often use them as a source of entertainment or as an aid in their learning and education. This research includes an introduction, a preface, four sections, and a conclusion. The first section addresses the crime of exploiting children in the production of videos on TikTok. The second section examines the crime of exploiting children in the procurement and distribution of drugs through modern technology. The third section explores the crime of exploiting children for illicit pleasure through modern technology. The fourth section addresses the crime of exploiting children through electronic blackmail. The conclusion summarizes the most important findings and recommendations, and includes a list of sources and references. This study concludes that the excessive use of modern technologies by children clearly contributes to their exploitation. Children at the beginning of their lives absorb modern technologies with all their numerous advantages and disadvantages, perhaps with the disadvantages outweighing the disadvantages.
