منهج الشيخ عبد الوهاب أبو سليمان الفقهي في بحث النوازل المالية المعاصرة - دراسة وصفية تحليلية The Methodology of Sheikh Abdul Wahhab Abu Sulaiman in Researching Contemporary Financial Issues: A Descriptive and Analytical Study

البحث يتكون من: مقدمة فيها: أهمية الموضوع وأسباب اختياره والدراسات السابقة وخطة البحث ومنهجه، وقد جاء البحث في تمهيد، وسبعة مباحث، وخاتمة، وفي البحث المعالم العامة لحياة الدكتور عبدالوهاب أبو سليمان - رحمه الله - وعناوين بعض كتبه، كما درس البحث طريقة الشيخ عبدالوهاب أبو سليمان في تصوير النازلة المالية المعاصرة، واهتمامه بتفكيكها وتحليلها، واعتماده على المتخصصين في هذا المجال، وكيفية نقله من كتب القانون العربية والإنجليزية ما يكشف عن حقيقة النازلة كما هي، وساعده على ذلك إتقانه اللغة الإنجليزية كما قام بدراسات ميدانية لمعرفة الواقع كما هو، ويبين الشيخ - رحمه الله - أطرافَ النازلة، ومركز كل طرف فقهًا، وقانونًا ويوضح العلاقة بينهم، ويعطي كل علاقة حكمها الفقهي، ويهتم الشيخ عبدالوهاب بالتكييف الفقهي للواقعة، ويبذل جهده في تخريجها على كلام الفقهاء وينقل نصوصهم من كتبهم المعتمدة في مذاهبهم مرتبًا لها بحسب التاريخ في أغلب أحواله، ليصل في النهاية إلى الحكم الكلي للنازلة بدليلها الشرعي، كما وضح البحث كيفية تعامل الشيخ عبدالوهاب مع الأدلة الشرعية، ومناقشة استدلالات المخالفين له، وطريقته في الترجيح، وكيفية توظيفه الفنون الفقهية في الحكم على النازلة من مثل المقاصد الشرعية، والقواعد الفقهية، والفرق الفقهي، وسائر العلوم الفقهية المؤثرة في حكمها، كما كشف البحث عن اهتمام الشيخ بقرارات مجمع الفقه الإسلامي، واستفادته منه، واحتفائه بها، وبعض المعالم العامة لفقه الشيخ عبدالوهاب. The research consists of an introduction covering the importance of the topic, the reasons for its selection, previous studies, and the research plan and methodology. The research is further divided into a preface, seven chapters, and a conclusion. It includes a general overview of the life of Dr. Abdul Wahab Abu Sulaiman (may God have mercy on him) and the titles of some of his books. The research also examines Sheikh Abdul Wahab Abu Sulaiman's approach to presenting contemporary financial issues, his focus on deconstructing and analyzing them, his reliance on specialists in the field, and how he drew upon Arabic and English legal texts to reveal the true nature of the issue. His mastery of English facilitated this, and he conducted field studies to understand the reality on the ground. The Sheikh (may God have mercy on him) identifies the parties involved in the issue, the sharian and jurisprudential standing of each party, and clarifies the relationships between them. He provides the appropriate sharian ruling for each relationship. Sheikh Abdul Wahab is meticulous in his jurisprudential classification of the issue, striving to apply it to the opinions of jurists and quoting their texts from authoritative books within their respective schools of thought. The research, arranged chronologically in most cases, ultimately arrives at a comprehensive ruling on the specific issue based on its sharian evidence.
