The Tunisian legislator has granted employers the right to dismiss workers for economic and technical reasons. However, under Law No. 101 of 1996, a social support system for dismissed workers was established to mitigate the serious economic and social consequences of dismissal. This study evaluates this law nearly three decades after its enactment, beginning with the question of whether it constitutes a solid foundation for establishing an unemployment insurance system for workers dismissed for economic reasons. The research reveals the limitations of this system by examining its logic, which relies on the temporary and selective withdrawal of certain limited and symbolic social security benefits, in addition to the provision of temporary cash assistance that does not rise to the level of a legal right. Furthermore, the law stipulates that certain legal entitlements of dismissed workers are assumed by legal subrogation of the employer, subject to stringent conditions. This has limited the law's success in achieving its objectives. Based on this evaluation, it can be concluded that the law is not sufficient to serve as a starting point for establishing an unemployment insurance system, and the legislator should consider... Its shortcomings were taken into account when drafting the details of the new unemployment insurance system announced by the 2025 Finance Law.
