The Rules Governing the Doctor-Patient Relationship in Islamic Jurisprudence
Abstract
This research addresses the Sharia rulings related to the doctor-patient relationship, entitled "The Doctor-Patient Relationship: A Comparative Jurisprudential Study." It aims to: clarify the boundaries of the doctor-patient relationship from the initial visit to the commencement of operations and related matters; and explain the permissibility of granting permission in Sharia rulings concerning the patient with the doctor's consent. The researcher employed an inductive approach by tracing the opinions of jurists in sources of jurisprudence, medical-jurisprudential encyclopedias, and all materials related to the study topic. An analytical approach was also used to analyze the jurists' opinions, arrive at general conclusions, and evaluate them. Among the most important findings are the following: the relationship between the doctor and the patient is a lease agreement, where the patient is the lessee and the doctor is the lessor; it is permissible for a woman to treat a man, as mentioned in the Sunnah; and the patient must adhere to the doctor's instructions to the best of their ability. To take the necessary steps towards healing, and considering that a doctor's touching a woman invalidates ablution, the researcher recommends holding educational seminars on Islamic jurisprudence for doctors so they are aware of these rulings. He also suggests that researchers should focus on addressing medical jurisprudence due to its relevance in our contemporary world.
