Abstract

This research addresses the issue of renewing the science of Islamic legal theory (Usul al-Fiqh) from an analytical and forward-looking perspective. It considers this science a foundational discipline in Islamic thought and a cornerstone of the methodology of ijtihad (independent reasoning) and the regulation of sharian deduction. The research's significance lies in its endeavor to reconnect Usul al-Fiqh with contemporary reality, renew its function in guiding thought and ijtihad, and provide a methodological framework that regulates the renewal process and protects it from excess or negligence, exaggeration or dissipation. It also contributes to building a knowledge base that can be used to develop educational and research methodologies for Islamic law, ensuring that Islamic law remains capable of adapting to the changing times and places. The research aims to identify contemporary trends in the call for renewing this science, analyze their justifications and parameters, and explore a future vision capable of revitalizing its effectiveness in addressing the challenges of our time. The research problem lies in exploring how and within what areas the science of Islamic jurisprudence (Usul al-Fiqh) can be renewed in a way that balances established sharian principles with the demands of contemporary reality, without compromising its authenticity and scientific methodology. The research adopted a descriptive, analytical, and comparative approach, drawing on classical sources and contemporary studies, and comparing the arguments and justifications of contemporary trends in the subject. Among the most prominent findings of the research is that renewal in Islamic jurisprudence is a sharian and intellectual necessity to keep Islamic law active in academic and practical life, provided it adheres to the sharian framework and overarching objectives. The research also highlighted that genuine renewal does not mean severing ties with the Islamic heritage, but rather activating, refining, and repurposing it to respond to contemporary issues within a balanced, forward-looking vision that combines tradition and modernity. Therefore, the researchers propose transforming the suggestions and forward-looking perspectives presented in this research into practical projects undertaken by institutions, academies, and academic centers, and intensifying the disciplined use of the humanities and modern technology to build a global Islamic jurisprudence discourse capable of engaging in dialogue with contemporary sharian and intellectual authorities.
