Abstract

This research aims to discuss a still-present and highly important problem, namely the age of puberty. I have exerted my efforts in this research to clarify the points of agreement and disagreement between Islamic Sharian and legal legislation, not in terms of which is more correct, but rather in terms of the extent to which Kuwaiti law conforms to Islamic jurisprudence regarding the age of puberty. It is known that puberty is the dividing line between one who is legally responsible and one who is not, and at this point a person becomes responsible for their actions. Jurisprudential and legal rulings are based upon it. The research focuses on issues related to a person from the time of their legal capacity as a fetus until they reach the age considered for puberty, including the age of minority, adulthood, puberty and its signs, legal capacity, and the scope of a minor's actions in financial transactions, personal status, criminal, and penal matters. Through these issues, I have discussed the legal discrepancies found in Kuwaiti law regarding the age of puberty and the rulings that result from it. In this research, I have adopted a comparative approach to the age of puberty between Islamic jurisprudence and Kuwaiti law. I identified the points of agreement and disagreement between Kuwaiti law and Islamic jurisprudence, drawing several conclusions, including: the difference in legal sources between Islamic jurisprudence, which derives its rulings from the Quran, Sunnah, and scholarly consensus, and Kuwaiti law, which derives its rulings from secular laws (except for personal status matters, which follow the Maliki school of jurisprudence); the lack of a fixed standard for determining the age of majority in Kuwaiti law; and the fact that Kuwaiti law is a product of human intellect, which is inherently flawed and requires continuous amendment to address shortcomings. There is a vast difference between divine and human legislation, a difference akin to that between Creator and creation.
