Work in exchange for a share of the output in Islamic jurisprudence and its contemporary applications: A comparative study
Abstract
This research aims to clarify an important concept in Islamic Sharia, namely the concept of work in exchange for a partial result of the contract. While the general principle is that a worker's labor should be in exchange for a known sum of money, in many cases the contracting parties may agree that the compensation for the work will be a portion of the contracted item. The topic of "work in exchange for a partial result of the contract" is a subtle subject that runs deep within Islamic sharia. It encompasses many contracts, such as lease, commission, profit-sharing, sharecropping, irrigation, and others. It also highlights the flexibility of Islamic law and its ability to accommodate the needs of the modern age. This research explores this concept, clarifying its conceptual framework. It then focuses on work in lease in exchange for a portion of the subject matter of the contract, whether this portion is specific or a known, common part. It also examines work in commission in exchange for a portion of the subject matter, defining commission and explaining its general permissibility. It then clarifies the ruling on work performed in this context in exchange for a portion of the subject matter. Furthermore, it explores the connection between profit-sharing and the concept of work performed in exchange for a portion of the subject matter, defining profit-sharing and explaining its ruling as a contract for work performed in exchange for a portion of the subject matter. The research also addresses the connection between sharecropping and irrigation and this concept, clarifying their rulings as contracts for work performed in exchange for a portion of the subject matter. Finally, the research examines several contemporary applications related to the concept of work performed in exchange for a portion of the subject matter. The conclusion of the research includes the most important points. Its recommendations and findings.
