Prophetic Commands Diverted from Their Intended Meaning from the Muwatta of Imam Malik ibn Anas Part 1An Applied Study of Islamic Jurisprudence
Abstract
This research examines the Prophetic commands found in the hadiths narrated by Imam Malik ibn Anas in his Muwatta, which scholars agree do not imply obligation and are therefore interpreted differently. The research is titled "Prophetic Commands Interpreted Differently from Their Implications in the Muwatta of Imam Malik ibn Anas: An Applied Fundamental Study." The research does not address commands that imply obligation, or those attributed to a Companion unless they are traced back to the Prophet through another chain of transmission. Similarly, it does not address statements attributed to Imam Malik or Imam Muhammad ibn al-Hasan, as found in his narration of the Muwatta. Since the order of the Muwatta varies according to its different narrations in terms of precedence, delay, addition, and omission, the narration of Yahya ibn Yahya al-Laythi is used. Because it is one of the most comprehensive and authoritative narrations of the Muwatta, and people in the East and West relied upon it, explaining and correcting it. Whenever the term "Muwatta" is used, it refers to it. The research concluded with a number of important findings, the most important of which are: that a command has a specific, inherently meaningful form, requiring no further additions; that context clarifies the wording and its interpretation, and helps in understanding the implications of the words, thus giving it a significant impact on understanding the divine discourse; that if a form is accompanied by context, its meaning is what the context indicates; but if it stands alone, there is disagreement about its meaning, with the prevailing view being that it implies obligation; that any context can shift the meaning of a command from its literal sense, whether it be a text, consensus, analogy, or something else, contrary to Ibn Hazm, who believes that the context that shifts the meaning of a command must be a text or consensus.
