Abstract
This research aims to examine consequences of employers' failure to provide compulsory health insurance to their employees, in accordance with the Cooperative Health Insurance Law and the Labor Law in Saudi Arabia. This study follows an analytical method by analysing laws and regulations. The study reaches several conclusions, most notably the lack in the legal protection for employees when the employer fails to provide the compulsory health insurance. The study, also, concludes that the employer's failure constitutes a fundamental breach of the employment contract, necessitating the application of the provisions of Article (81) of the Labor Law, which allows the employee to terminate the employment contract while preserving his full statutory rights, and the right to claim compensation. The study also concludes that the compensation is not sufficiently clear, which requires further attention from the Saudi regulator to clarify the scope of compensation. Moreover, the study recommends defining the scope of compensation as a right for employees according to the Saudi Labor Law. Also, the study recommends that the necessity of stipulating the right of Saudi and non-Saudi employees to provide them with compulsory health insurance in the Labor Law. Finally, the study recommended amending Article (14) of the Cooperative Health Insurance Law so that the penalties include the worker's right to claim a compensation. Also, amending the text of Article (38) of the Cooperative Health Insurance Law, which stipulates the right of the insurer to cancel the insurance policy when the employer fails to pay insurance premiums.
