الحماية الدستورية لحق الحصول على الجنسية العربية السعودية

بالرغم من أن موضوع حقوق الإنسان يتمتع بحماية دولية، إلا أن الحماية الوطنية للحقوق لها الأولوية، وذلك نظرًا لأن القوانين والأنظمة الوطنية هي خط الدفاع الأول عن هذه الحقوق، حال حدوث انتهاك لها. عند تفسير حق الجنسية من واقع أنه حق من حقوق الإنسان، علينا أن نأخذ في الحسبان أن مستلزمات ومقومات منح الجنسية تقع ضمن الاختصاص القضائي الداخلي للدول، خاصة عندما لا يتم حسمها من القانون الدولي. فعلى الرغم من هيمنة الجانب الدولي في العديد من أمور حقوق الإنسان، إلا أن حق الجنسية لا يزال خاضعا للأنظمة المحلية لكل دولة، التي يعد الدستور أقواها. فالدستور السعودي، كغيره من دساتير الدول الأخرى، يتناول الجنسية من واقع أنها أحد الموضوعات الدستورية بدلاً من اعتبارها من حقوق الإنسان، مما يؤكد فرضية البحث المتمثلة في أهمية إعطاء الأولوية للأنظمة الدستورية في الموضوعات التي لا يتم حسمها في القانون الدولي، مثل الجنسية.
