علاقة اعتبار المآلات بمقاصد الشريعة- وأثرها في الحفاظ على الأسرة المسلمة في المهاجر "دراسة أصولية تطبيقية"

يخلص البحث إلى أن إعمال أصل اعتبار المآل يسهم في تحقيق المقاصد الضرورية والحاجية، وأهميته في ضمان استقرار الأسرة المسلمة بوصفها نواة أساسية في الحفاظ على الهوية الإسلامية في المهاجر. وقد اشتمل البحث على: مقدمة، وثلاثة مباحث، وخاتمة. أما المقدمة: فتضُم أسباب اختيار الموضوع، والدراسات السابقة، ومشكلات البحث ومنهجه، وعملي في البحث وخطته. وأما المبحث الأول: فقد اشتمل على بيان مفهوم اعتبار المآلات وأدلة اعتبارها، وعلاقة مآلات الأفعال بالمقاصد الشرعية، والقواعد المتفرعة عن قاعدة اعتبار المآلات. وأما المبحث الثاني: فقد اشتمل على بيان مفهوم الأسرة المسلمة ومقاصدها في الشريعة الإسلامية، وبيان المقصود بالمهاجر وأسباب الهجرة. وأما المبحث الثالث: فقد اشتمل على تطبيقات اعتبار المآل في زواج المسلم من الكتابية، واعتبار المآل في منع الزواج الصوري، واعتبار مآلات قبول الولاية العامة عند تعذُّر الولي الشرعي، واعتبار المآل في عمل المرأة، واعتبار المآل في إثبات نسب ابن الزنا لأبيه، وبيان دور اعتبار المآلات في الحفاظ على الأسرة المسلمة في المهاجر. وأما الخاتمة: فقد اشتملت على أهم ما توصلت إليه من نتائج وتوصيات. This thesis is reaching out the fundamentals of intentions that collaborate with the necessary targets and the needs and its importances in guaranteeing the stabilities of the Islamic families as a basic core to preserve the Islamic identities at overseas as this thesis has included : preface and three chapters and conclusion Preface : it is including the reason of studying this topic and the previous studies and the problems of the research and methodologies and plans set First Chapter ; it includes the indemnification of the intentions accordingly with the evidences of intentions as a relation with the actions of the sharia targets and the branched rules generated from the intentions bases Second Chapter: it includes the identification of the Islamic families identity and their intentions in Islamic Sharia and the meaning of immigrant and reason for immigration Third Chapter: it includes the applications of consideration of intentions in the Islamic Marriage in written sense and the consideration of intentions in impediments of false marriage and the consideration of accepting the general custodianship if prevented by the legal guardian and the considerations of intention of working women and the prove of siblings in case of adultery and the clarification of intentions in preserving the Islamic families overseas Conclusion : it includes most important results and recommendations
