Abstract

[282]. The research is summarized in identifying what the term and obligations are in language and Islamic jurisprudence, the jurisprudential basis for adding the obligation to a term, the sources of this legitimacy from the agreement, the legal term, the judicial term, and the conditions for adding the obligation to a term, and these conditions are that the term is future, and that it is This term is certain to occur, and the forms of adding the obligation to a term, and one of these forms is that the period of addition is a future period, to which the delivery of the eye is added, as mentioned in Salam of adding the delivered eye to a known time, because Salam is the delivery of a present eye in a consideration described in the mind for a term , and from the added contracts as well: As we have said, the added lease is a considered lease from a future time, and therefore it is contractual, but the property cannot be established until the time comes, and I also address the cases of the loss of the term and the immediate obligation, including the loss of the term by bankruptcy or insolvency, and the death of the debtor. In this research, I have concluded that the term is permissible in Islamic law, based on many Qur'anic verses and hadiths. The Almighty says:“O you who believe, when you owe a debt to a named date”,([[1]])and the Almighty said in urging the creditor to consider his insolventdebtoruntil the time of his solvency. ([1]) - ([1]) Surat al-Baqarah: Verse [282].
