(المسائل الأصولية المتعلقة بالحكم الشرعي للقاضي الشهاب (المتوفى سنة: 1069هـ) في حاشيته على تفسير الإمام البيضاوي (المتوفى سنة: 685هـ "جمعا وتوثيقا ودراسة").

بحث بعنوان: (المسائل الأصولية المتعلقة بالحكم الشرعي في حاشية الشهاب على تفسير البيضاوي "جمعاً ودراسة") وقد جمعت فيه المسائل الأصولية المتعلقة بالحكم الشرعي التي وردت في حاشية القاضي الشهاب, المسماة: "عناية القاضي وكفاية الراضي على تفسير الإمام البيضاوي" وقد تناولتها بشيءٍ من التوضيح، بعيدًا عن الإسهاب والإطناب. وكان مُجمل هذه المسائل التي وقفت عليها من خلال هذه الحاشية خمس عشرة مسألة (تعريف الحكم التكليفي, فرض العين والكفاية وحكمهما- تعريف الواجب والحرام وحكمهما- تعريف المندوب وحكمه- تعريف المباح وحكمه- ما لا يتم الواجب إلا به, فهو واجب - تعريف خطاب الوضع- تعريف الرخصة والعزيمة- الإكراه الملجىء يمنع التكليف، لزوال القدرة عليه بالاتفاق, وأمّا غير الملجىء, ففيه خلاف- الكفار مخاطبون بفروع الشريعة- تكليف الجن- الأصل في الأشياء الإباحة). وتكمن أهمية هذا البحث في أن علم أصول الفقه علمٌ جليل القدر، عظيم الفائدة والأثر، وقد قيض الله لهذا العلم علماء أفذاذًا وضعوا قواعده وضوابطه التي لابد للمجتهد أن يحيط بها، ويسير عليها في استنباطه للأحكام الشرعية، وأولئك العلماء منهم من ألف المؤلفات الكثيرة في هذا الفن، ومنهم من له آراؤه المبثوثة في تلك الكتب، ولم يكن له مؤلَّف خاص، أو أن ما ألَّفه لم يرَ النور بعد، ويأتي هذا البحث ضمن الجهود الرامية إلى جمع وتوثيق بعض تلك الآراء، من خلال تناوله آراء أحد كبار علماء الحنفية وهو الإمام القاضي الشهاب الخفاجي، وشعورًا بأهمية هذا العلم الذي يُعد شرطًا من شروط المفسر, وكجزءٍ من الوفاء لهذا العالم الجليل, وخدمة لهذا التفسير قمت بإعداد هذا البحث. وتكمن أيضًا أهمية هذا البحث فيما للحكم الشرعي من أهمية في أنه يوضح للمسلم أحكامه في مختلف جوانب حياته، مثل العبادات, والمعاملات، مما يصحح عمله ويجعله يؤدي العبادات بشكل صحيح، كما يساعد على فهم الحقوق والواجبات في المجتمع. وقد جاء هذا البحث في مقدمة, وتمهيد, ومبحثين, وخاتمة, أمَّا التمهيد: ففي التعريف بالقاضي الشهاب, وحاشيته (عناية القاضي وكفاية الراضي), والتعريف بالإمام البيضاوي وتفسيره, ويشتمل على أربعة مطالب:المطلب الأول: التعريف بالقاضي الشهاب.المطلب الثاني: التعريف بحاشية القاضي الشهاب (عناية القاضي وكفاية الراضي).المطلب الثالث: التعريف بالإمام البيضاوي.المطلب الرابع: التعريف بتفسير الإمام البيضاوي (أنوار التنزيل وأسرار التأويل), وأما المبحث الأول: ففي المسائل الأصولية المتعلقة بالحكم التكليفي, وأما المبحث الثاني ففي المسائل الأصولية المتعلقة بالحكم الوضعي, والمحكوم عليه, والمحكوم فيه, وأما الخاتمة, فتناولت فيها أهم النتائج التي توصلت إليها من خلال هذا البحث. This research, titled "Fundamental Issues Related to Islamic Rulings in Al-Shihab's Commentary on Al-Baydawi's Interpretation: A Compilation and Study," compiles the fundamental issues related to Islamic rulings found in Judge Al-Shihab's commentary, entitled "The Judge's Care and Al-Radi's Sufficiency on Imam Al-Baydawi's Interpretation." These issues are addressed with some clarity, avoiding excessive detail and digression.These issues, which I identified through this commentary, comprise fifteen points: (Definition of a legal ruling; individual and collective obligations and their rulings; Definition of obligatory and prohibited acts and their rulings; Definition of recommended acts and their rulings; Definition of permissible acts and their rulings; That without which an obligation cannot be fulfilled is itself obligatory; Definition of a legally binding statement; Definition of a dispensation and a binding obligation; Compelling duress prevents obligation due to the loss of capacity, by consensus; Non-compelling duress is subject to differing opinions; Non-Muslims are addressed by the branches of Islamic law; The obligation of jinn; The default state of things is permissibility). The importance of this research lies in the fact that the science of Islamic jurisprudence (Usul al-Fiqh) is a highly esteemed and influential field. God has blessed this science with eminent scholars who established its rules and principles, which every jurist must be familiar with and follow in deriving legal rulings. Some of these scholars authored numerous works on this subject, while others have their opinions scattered throughout these books, without having authored a separate work, or whose writings have not yet been published. This research is part of the efforts to collect and document some of these opinions, focusing on the views of one of the leading Hanafi scholars, Imam Qadi Shihab al-Khafaji. Recognizing the importance of this science, which is a prerequisite for a qualified interpreter of the Quran, and as a tribute to this eminent scholar and a service to the field of Quranic exegesis, I have prepared this research.The importance of this research also lies in the significance of Islamic legal rulings, as they clarify for Muslims the rulings governing various aspects of their lives, such as acts of worship and transactions. This ensures the correctness of their actions and enables them to perform religious duties properly. Furthermore, it helps in understanding rights and obligations within society. This research is presented in an introduction, a preface, two main sections, and a conclusion. The preface introduces Qadi al-Shihab and his commentary (Inayat al-Qadi wa Kifayat al-Radi), and introduces Imam al-Baydawi and his commentary. It comprises four subsections:Subsection 1: An introduction to Qadi al-Shihab.Subsection 2: An introduction to Qadi al-Shihab's commentary (Inayat al-Qadi wa Kifayat al-Radi).Subsection 3: An introduction to Imam al-Baydawi.Subsection 4: An introduction to Imam al-Baydawi's commentary (Anwar al-Tanzil wa Asrar al-Ta'wil). The first main section addresses the fundamental principles related to the obligatory ruling (hukm taklifi). The second main section addresses the fundamental principles related to the declaratory ruling (hukm wad'i), the subject of the ruling, and the subject of the ruling. The conclusion summarizes the most important findings of this research.
