Abstract

This study analyzes the legal dimensions of liability and compensation within the framework of non-traditional data insurance, considering it a new legal development driven by technological advancements and the digital economy. It focuses on examining the liability arising from data breaches and investigates the compensation mechanisms provided by this non-traditional insurance system for data protection. The thesis offers an in-depth analysis of the concept of legal liability for data incidents, differentiating between its two primary pillars: contractual liability and tortious liability. Regarding contractual liability, the study highlights the obligations of technology service providers to ensure data security under contracts with their clients. It also discusses the liability of the insured towards third parties with whom they have contracted. As for tortious liability, the study examines the liability of the direct perpetrator of the harm (whether a cybercriminal or a negligent employee), emphasizing the legal and practical challenges in prosecuting hackers. It also focuses on the liability of data-owning entities for their negligence in protecting data, stressing the necessity of proving the causal link between the fault and the harm, which poses a complex technical and legal challenge. The study adopts a comparative analytical approach between Egyptian, Kuwaiti, and European laws to clarify the similarities and differences in defining the scope of liability, the bases for compensation, and the necessary legal guarantees for activating non-traditional data insurance. The study concludes that the absence of explicit legal regulation for non-traditional data insurance in most legislations raises issues related to determining the nature of liability (contractual or tortious), the scope of compensation, and the criteria for risk distribution among service providers and the insured. The findings underscore the need for a comprehensive legal framework that considers the intangible nature of data as an asset, ensures effective compensation, and aligns with the general principles of civil liability and the demands of the contemporary digital economy.
