Abstract
This study aims to establish a methodological foundation for ijtihād al-tanzīl (applied juristic reasoning) as the principal tool for regulating fatwa in contemporary legal-ethical issues (nawāzil). It seeks to shift the Sharīʿah ruling from abstract theoretical understanding to concrete, case-specific application. The research adopts a composite methodology—inductive, analytical, and applicative. It examines the concept of applied ijtihād, clarifies its pillars, and highlights the necessity of epistemic integration between the jurist and the scientific expert. The study identifies the procedural mechanisms required for proper application, beginning with the scientific diagnosis of the case (taḥqīq al-manāṭ) through consulting specialists to examine components, production methods, and potential risks, followed by the evidential engagement of relevant texts, legal maxims, and juristic principles, and concluding with consideration of outcomes and balancing benefits and harms in light of the higher objectives of Sharīʿah. On the applied level, the study presents detailed rulings on key contemporary food innovations: Genetically modified foods (GMFs): The default ruling is permissibility, provided that they yield a valid benefit—such as food security—are free from proven harm, and do not involve prohibited genetic sources such as pigs. Cultured (lab-grown) meat: Its ruling depends on two essential conditions: Purity of source, meaning the initial cell must come from a lawful and properly slaughtered animal; and Purity of the medium, meaning the growth substrate must be free from impurities such as flowing blood. Insects as food: The ruling ranges from prohibition, according to the majority of jurists, to permissibility, according to the Mālikī school, provided no verified health risks are associated with their consumption. The study recommends activating collective ijtihād in these complex bio-food issues and reaffirms the flexibility and adaptability of Islamic law in accommodating scientific and technological advancements, in a manner that fulfills its objectives of preserving life, intellect, and overall human welfare.
