التكامل بين الآراء الفقهية والمرجعية الطبية وأثره في قضايا النسب "دراسة تطبيقية على مدة الحمل والبصمة الوراثية"

تتناول هذه الدراسة قضايا النسب بوصفها من أدق المسائل الشرعية وأكثرها تأثيرًا في استقرار الأسرة، وذلك في ظل التطور الطبي المتسارع في علوم الوراثة الذي أفرز معطيات جديدة قد تتعارض ظاهريًّا مع الأحكام الفقهية المستقرة؛ حيث يسعى البحث إلى تأسيس منهج علمي تكاملي يجمع بين الآراء الفقهية والمرجعية الطبية لحل هذا التعارض الصوري، لا سيما في مسألتي "مدة الحمل" و"البصمة الوراثية"، بهدف بيان أثر هذا التكامل في ضبط النوازل، وتوظيف الحقائق العلمية قرينةً قوية في البناء الاجتهادي دون مصادمة الأصول الشرعية، مبرهنًا بذلك على أن التلازم بين الفقه والطب ضرورة ملحة لترشيد الفتوى، وتحقيق العدالة القضائية، وصيانة المجتمع من اضطراب الأنساب. This study examines the issues of lineage (Nasab) as one of the most intricate Sharia matters significantly impacting family stability, particularly in light of rapid medical advancements in genetics that have introduced new data potentially conflicting—on the surface—with settled jurisprudential rulings. The research seeks to establish an integrated scientific methodology that bridges the gap between Islamic jurisprudence (Fiqh) and medical references to resolve this apparent conflict, specifically regarding the issues of "gestation period" and "DNA fingerprinting." It aims to demonstrate the impact of this integration in regulating contemporary medical developments (Nawazil) and utilizing scientific facts as robust evidence in the process of Ijtihad (independent legal reasoning) without contradicting Sharia principles. Ultimately, the study proves that the synergy between Fiqh and medicine is an urgent necessity for rationalizing Fatwas, achieving judicial justice, and safeguarding society from the confusion of lineages.
