الحماية الجنائية لبراءات الاختراع والنماذج الصناعية "دراسة تحليلية في النظام السعودي" Criminal Protection of Patents and Industrial Designs An Analytical Study under the Saudi law

يعد من بين الركائز الأساسية لحماية الابتكار والملكية الفكرية ضمان حماية حقوق براءات الاختراع والنماذج الصناعية؛ لما تمثله من قيمة علمية واقتصادية متنامية. وتبرز الحماية الجنائية كضمانة جوهرية لمكافحة الاعتداءات التي تهدد تلك الحقوق. وعليه تبحث الدراسة من منظور تأصيلي تحليلي الحماية الجنائية لبراءات الاختراع والنماذج الصناعية في النظام السعودي، كأحد أهم صور الملكية الفكرية التي تستهدف المملكة العربية السعودية تنميتها وحمايتها في ظل مستهدفات رؤية 2030. وتزداد أهمية هذه الحماية بالنظر إلى ما تمثله براءات الاختراع والنماذج الصناعية من قيمة اقتصادية ودور محوري في دعم الابتكار، مما استدعى تدخل المنظم السعودي عبر إقرار أنظمة خاصة، مثل نظام براءات الاختراع والتصميمات التخطيطية للدارات المتكاملة والأصناف النباتية والنماذج الصناعية، وما تضمنته من لوائح تنفيذية. وقد أرست هذه المنظومة مجموعة من الضمانات الموضوعية والإجرائية التي تكفل الحماية الجنائية لهذه الحقوق من صور الاعتداء المختلفة، ولا سيما جرائم التقليد وما في حكمها، بما يحقق الردع ويعزز الثقة في بيئة الاستثمار. Among the fundamental pillars of safeguarding innovation and intellectual property is ensuring the protection of patent rights and industrial designs, given their growing scientific and economic value. Criminal protection thus emerges as a key guarantee against infringements that threaten such rights. Accordingly, this study undertakes a doctrinal and analytical examination of the criminal protection of patents and industrial designs under the Saudi laws, as one of the most significant forms of intellectual property that the Kingdom of Saudi Arabia seeks to foster and safeguard within the framework of Vision 2030. The importance of this protection is further underscored by the economic value and pivotal role that patents, and industrial designs play in supporting innovation, which has necessitated the intervention of the Saudi legislator through the enactment of specialized regulations, such as the Law of Patents, Layout-Designs of Integrated Circuits, Plant Varieties, and Industrial Designs, together with their implementing regulations. This legal framework has established a set of substantive and procedural safeguards ensuring the criminal protection of these rights against various forms of infringement, particularly counterfeiting and analogous offenses, thereby achieving deterrence and reinforcing confidence in the investment environment.
