Abstract
Autonomous medical robots represent one of the most advanced developments of artificial intelligence in the healthcare sector, having introduced a qualitative shift in methods of diagnosis, treatment, and medical care management through independent operating systems capable of decision-making and performing tasks without direct human intervention. This study aims to clarify the reality of these robots by defining them, identifying their essential characteristics and potential risks, outlining the Sharia rulings related to their use, determining their juristic classification, and examining the legal responsibility arising from their actions, given that they are machines devoid of will and legal capacity, regardless of how closely their behaviors may resemble human performance. The research adopts the descriptive method to present the current state and characteristics of autonomous medical robots; the inductive-analytical method to trace relevant Sharia evidences and juristic principles and analyze their applicability to contemporary autonomous medical robots; and the comparative method to evaluate the differing juristic opinions regarding their permissibility and the responsibility for their outcomes. The study concludes that Islamic law is capable of accommodating such technological developments due to its flexibility and consistent legal principles, and that the autonomous medical robot is a material entity lacking legal capacity, with its actions attributable to its programmer or operator. It also concludes that the default ruling on its use is permissibility when safety predominates, efficiency is established, and harm is absent, and that experiments involving such robots are impermissible when they involve actual or probable harm—except in cases of necessity or urgent need and in a manner that ensures the preservation of human life. The research further supports treating autonomous medical robots analogously to animals regarding liability, whereby the legally responsible party bears the consequences of their actions according to the extent of causation or negligence. The study ultimately emphasizes the need to establish a comprehensive Sharia-based regulatory framework governing the use of autonomous medical robots, enhance awareness of their risks and benefits, and open new research avenues capable of keeping pace with the rapid development of this field while adhering to the objectives of Islamic law.
