Abstract
This research examines the new legal framework for housing finance and real estate mortgages in the State of Kuwait issued in 2025, through an analysis of the statutory provisions governing housing finance and mortgage arrangements, clarification of its legislative structure, and a comparative juristic–legal evaluation in light of the overarching principles of financial transactions in Islamic law. The study addresses a central problem arising from the law’s broad and flexible drafting, as it does not specify the financing formula adopted, the nature of the returns generated by the financing, nor the detailed role of the real estate developer, which raises juristic concerns regarding its compliance with Islamic law under varying modes of application. Employing a comparative analytical methodology, the research analyzes the relevant legal texts, constructs potential practical scenarios, and provides an independent juristic characterization for each, while taking into account the objectives of Islamic law (maqāṣid al-sharīʿah) and the social considerations associated with housing. The study concludes that the new Kuwaiti legal framework is, in principle, compatible with Islamic law and inherently capable of such compliance, provided that it is implemented through Sharia-compliant financing structures and that its executive mechanisms are carefully regulated to prevent deviation from its intended social purpose. It further recommends enhancing legislative clarity regarding financing formulas and returns, regulating the role of the real estate developer, linking the mortgage to the nature of the secured obligation, and activating Sharia-compliant investment mechanisms in a manner that balances the protection of financiers’ rights, the preservation of private property, and the achievement of housing stability.
