إنسانية الشريعة الإسلامية في التعامل مع تصرفات المريض مرض الموت دراسة فقهية مقارنة

الشريعة الإسلامية دستور إنسانيٌّ متكامل يجمع بين العدل والرحمة؛ فمن أجَلِّ ما تمتاز به شريعتنا الغراءُ إنسانيتُها المطلقة، ومراعاتها لأحوال المكلفين في مختلف مراحل حياتهم، وفيما يعرض لهم من عوارض قد تؤثر على سلامة تصرفاتهم، ومن ذلك مرضُ الموت الذي يعد وقتاً حرجاً في حياة الإنسان؛ لذا فإن هذا البحث يُظهر الأسس الشرعية الإنسانية التي تحكم تصرفات المريض مرضَ الموت، وتحقق العدالة في توزيع الحقوق، وتضمن عدم استغلال حالته الصحية في اتخاذ قرارات قد تؤثر سلبًا على الورثة أو المجتمع، وذلك من خلال المقارنة بين مختلف الآراء الفقهية في المسائل التي تتعلق بالمريض في مرض الموت وذلك كالطلاق والنكاح والبيع والإقرار والهبة. وبذلك يسعى هذا البحث إلى تقديم رؤية متكاملة حول إنسانية الشريعة الإسلامية في هذا الموضوع، وإبراز الجوانب الفقهية والإنسانية التي تبرهن على شمولية الإسلام في تحقيق العدل والرحمة في جميع الأحوال، كما تبرهن على الفهم العميق للأقوال الفقهية المختلفة، فإن سادتنا الفقهاء لم يتعاملوا مع المسائل والقضايا تعاملاً خالياً من رعاية المصالح والنظر إلى المآلات، بل كانت نظرتهم محققة للتوازن بين المصالح العاجلة والآجلة. Islamic law is characterized by its absolute humanity and its consideration of the conditions of the accountable individuals in various stages of their lives, as well as the circumstances that may affect the soundness of their actions. Among these is the illness that occurs at the approach of death, which is a critical period in a person's life. Therefore, this research seeks to highlight the humanitarian legal foundations that govern the behavior of the patient, ensure justice in the distribution of rights, and safeguard against exploiting the patient's health condition when making decisions that might negatively affect the heirs or society. This is achieved by comparing different juristic opinions on issues related to the patient at the time of terminal illness, including divorce, marriage, sale, acknowledgment, and gifts. Thus, this research aims to provide a comprehensive perspective on the humanity of Islamic law in this matter and to highlight the juristic and humanitarian aspects that demonstrate Islam’s comprehensiveness in achieving justice and mercy in all circumstances.
