Abstract

This research addresses the issue of procedural protection of witnesses in criminal law through an analytical and comparative study between the Saudi legal system and selected comparative legal systems, in light of the essential role that testimony plays in uncovering the truth and achieving criminal justice, as well as the risks surrounding it that may affect the witness’s will or physical and moral integrity. The study aims to clarify the concept of procedural protection of witnesses, its legal basis, its various forms, and the adequacy of the mechanisms adopted to ensure the effectiveness of testimony and to protect witnesses from threats, retaliation, or unlawful influence. The research adopts a comparative analytical approach by examining the relevant legal provisions in the Saudi legal system, particularly the Law of Criminal Procedure, and comparing them with corresponding legislation in other legal systems and relevant international conventions. The study also addresses various forms of procedural protection, such as non-disclosure of the witness’s identity, confidentiality of information, provision of security protection, and the use of modern technological means in hearing testimony. The research concludes that the Saudi legal system implicitly recognizes the principle of witness protection through procedural rules, although it lacks independent and comprehensive legislative texts, unlike some comparative legal systems that have enacted integrated legislation specifically for the protection of witnesses. The study recommends strengthening the legal framework governing the procedural protection of witnesses, expanding its scope, and activating technological means in a manner that achieves a balance between safeguarding the rights of the defense and protecting witnesses, thereby enhancing confidence in criminal justice.
