Abstract

This study examines the scope of ijtihād and its applications in contemporary medical issues, as one of the most significant fields of modern juristic reasoning. The importance of ijtihād lies in its ability to determine Islamic legal rulings for newly emerging cases and unprecedented issues. Given the continuous evolution of human needs, the rapid development of medical sciences, and the emergence of novel medical practices, there is a pressing need for qualified scholars to engage in ijtihād in order to ascertain Shariah rulings that fulfill people’s interests and realize the objectives of Islamic law. Islam has opened the door of ijtihād in matters for which there is no explicit textual evidence, or where the existing text allows for juristic interpretation. This ensures the flexibility and universality of Islamic law, enabling it to accommodate new circumstances, evolving customs, changing interests, and the progression of time. Ijtihād in contemporary medical issues is considered one of the most delicate and complex areas of modern jurisprudence, as it is directly related to fundamental objectives of Shariah, particularly the preservation of life and lineage. In the modern era, numerous medical cases have emerged that were unknown to earlier scholars, prompting contemporary jurists and Islamic juristic councils to exert collective ijtihād in addressing these issues in accordance with established legal principles and objectives. The study begins with an introductory section that defines ijtihād, clarifies its legitimacy, and explains its legal ruling. The first chapter discusses the scope of ijtihād, outlining matters in which ijtihād is permissible and those in which it is not, in light of foundational principles of Islamic jurisprudence. The second chapter presents applied models of ijtihād in selected contemporary medical issues, as addressed by scholars and Islamic juristic councils. The study concludes that the scope of ijtihād is confined to practical legal rulings that are speculative in terms of their transmission, indication, or both, as well as matters for which there is no definitive textual evidence, and that there is no room for ijtihād in rulings that are definitive in both transmission and meaning.
