Abstract

This research examines the "Salam Contract" (Forward Sale) through a comparative jurisprudential (Fiqh) study combined with an analysis of contemporary applications. It aims to highlight the contract's capacity, through its various legal rulings, to address modern financing challenges. The research begins by defining Salam linguistically and idiomatically across different schools of Islamic jurisprudence, selecting a preferred definition and clarifying the relationship between its linguistic and technical meanings. It then outlines the rulings of the Salam contract by detailing its pillars and the conditions for its validity—whether regarding the capital (Ra’s al-Mal), the buyer (Al-Muslam), the subject matter (Al-Muslam Fihi), or the seller (Al-Muslam Ilayhi(. Furthermore, the study analyzes its diverse applications in the agriculture, industry, and energy sectors. It sheds particular light on the use of Salam in banking transactions through "Parallel Salam" and "Salam Sukuk," while addressing emerging issues in e-commerce and the concept of constructive possession (Al-Qabd al-Hukmi). The research concludes that the Salam contract represents the most efficient Sharia-compliant alternative for financing working capital, provided there is adherence to regulations regarding the elimination of uncertainty (Jahala) and the independence of parallel contracts. It recommends the necessity of developing unified international standards to regulate the digital receipt of payments.
