Abstract

The contemporary era is witnessing a remarkable expansion in the use of digital products-such as software, applications, electronic platforms, and artificial intelligence-which has given rise to new forms of harm resulting from technical malfunctions, programming defects, and inadequate cybersecurity protection. These developments raise fundamental legal issues concerning the determination of the appropriate basis for civil liability arising from such products, given their distinctive nature compared to traditional tangible products. This research examines the legal foundations of civil liability-both contractual and tortious-for digital products under positive law, through an analysis of the obligations of digital product providers, liability for latent defects, professional fault, negligence in updating and technical support, as well as the liability of platform operators and cloud service providers. It also explores the Sharia foundations of liability in Islamic jurisprudence through rules of guarantee (ḍamān), such as: “Whoever causes damage to another’s property is liable for it,” “Harm must be removed,” “The liability of craftsmen,” and “Liability based on causation,” and their application to digital defects. The study then conducts a comparative analysis between the sharia-based and legal frameworks to highlight differences in assessing faults, damage, and causation. It concludes that it is possible to construct a contemporary legislative framework grounded in Islamic jurisprudential principles that accommodates the nature of the digital environment, thereby contributing to the protection of users, the achievement of justice, and the proper regulation of civil liability in the modern technological domain.
