الضبط الإداري بين الرقابة القضائية ومستهدفات رؤية 2030

تُعد الرقابة القضائية على أعمال الضبط الإداري من أهم أدوات تحقيق دولة القانون وتعزيز مبادئ العدالة وسيادة النظام القانوني في الدولة الحديثة، لما لها من دور أساس في ضبط مشروعية التدابير والقرارات الإدارية الرامية إلى حماية الأمن والنظام العام والصحة العامة والسكينة الاجتماعية. ويكتسب هذا الموضوع أهمية خاصة في المملكة العربية السعودية في ظل التحولات الكبرى التي تشهدها هياكل الدولة ومؤسساتها القانونية والتنظيمية ضمن إطار تحقيق مستهدفات رؤية المملكة 2030، التي تؤكد على ضرورة بناء جهاز إداري فعال، قائم على الشفافية والمساءلة والحوكمة الرشيدة، ويحترم حقوق الإنسان ويوازن بين المصلحة العامة والحقوق الفردية. وتهدف هذه الدراسة إلى تحليل مفهوم الرقابة القضائية على أعمال الضابط الإداري وبيان نطاقها وحدودها، واستقصاء دور القضاء الإداري في ضمان مشروعية الإجراءات والتدابير المتخذة في مجال الضبط الإداري، مع التركيز على مدى توافق هذه الرقابة مع مبادئ العدالة الدستورية ومتطلبات حماية الحقوق والحريات الأساسية. كما تتناول الدراسة تطور الإطار القضائي والتنظيمي في المملكة، ومدى إسهام القضاء الإداري في دعم الشفافية، ومنع التعسف في استعمال السلطة، وترسيخ ثقافة احترام سيادة القانون داخل الأجهزة الإدارية. وتسعى الدراسة كذلك إلى بيان العلاقة التفاعلية بين الرقابة القضائية ومتطلبات تحقيق مستهدفات رؤية السعودية 2030، من حيث تعزيز ثقة المجتمع في القضاء والإدارة، ودعم كفاءة الأجهزة الحكومية، وتحقيق بيئة قانونية مستقرة وجاذبة للتنمية والاستثمار، فضلاً عن تعزيز العدالة الإدارية التي تعد ركيزة أساسية لبناء دولة فاعلة ومجتمع حيوي واقتصاد مزدهر. وتخلص الدراسة إلى أن تطوير وتعزيز آليات الرقابة القضائية على أعمال الضبط الإداري يسهم بشكل مباشر في حماية الحقوق، وترسيخ سيادة القانون، وتحقيق التوازن الدقيق بين متطلبات الأمن والنظام العام من جهة، وضمان الحرية الفردية والكرامة الإنسانية من جهة أخرى، بما يتوافق مع تطلعات رؤية المملكة نحو منظومة عدلية وإدارية متقدمة تتسم بالكفاءة والعدالة والشفافية. Judicial oversight of administrative police actions constitutes a cornerstone in reinforcing the rule of law, safeguarding fundamental rights and freedoms, and ensuring that public authorities exercise their powers within the limits of legality and justice. This topic gains particular significance in the Kingdom of Saudi Arabia within the context of the profound institutional and legal reforms associated with Saudi Vision 2030, which emphasizes building an efficient, transparent, accountable, and governance-driven administrative system that upholds human rights, strengthens public trust, and achieves a balanced relationship between public interest and individual liberties. This study aims to analyze the concept, scope, and limits of judicial review over administrative police measures, highlighting the essential role of the administrative judiciary in examining the legality, proportionality, and necessity of decisions issued to maintain public order, security, health, and societal stability. It further explores the judicial framework in Saudi Arabia and the evolution of judicial control mechanisms, assessing their contribution to promoting transparency, preventing abuse of power, consolidating the rule of law, and embedding a legal culture grounded in accountability and respect for rights. Moreover, the study sheds light on the dynamic relationship between judicial oversight and Saudi Vision 2030, demonstrating how effective judicial review enhances institutional performance, strengthens public confidence in judicial and administrative institutions, and supports the creation of a stable and reliable legal environment conducive to development and investment. The study concludes that strengthening judicial oversight over administrative police activities plays a decisive role in protecting individual rights, ensuring fair administrative justice, and achieving a nuanced balance between security imperatives and personal freedoms, thus aligning with Vision 2030’s aspirations for a vibrant society, a thriving economy, and an effective state founded on justice, transparency, and the rule of law.
