المسئولية الدولية عن استخدام الذكاء الاصطناعي في المجال العسكري

لقد أصبحنا نشهد تفوقًا تقنيًّا وتكنولوجيًّا متسارعًا جعل الآلات تحل محل البشر في تأدية الكثير من المهام والوظائف، نظرًا لقدرتها الفائقة على التخزين ومعالجة البيانات وتحليل المعلومات؛ مما جعلها قادرة على اتخاذ القرارات بكفاءة قد تفوق البشر؛ وعلى الرغم من إيجابيات هذه التكنولوجيا الذكية إلا أنها في حقيقتها سلاح ذو حدين؛ تحمل في طياتها العديد من المخاطر خاصة متى استخدمت في التسليح وإدارة الحروب؛ فقد نجح الذكاء الاصطناعي ليس فقط في تغيير شكل السلاح التقليدي بل استطاع تغيير مفهوم الحرب التقليدية للحرب الإلكترونية، وخاصة بعد ابتكار الروبوتات المقاتلة والأسلحة ذاتية التشغيل التي تملك القدرة على تحديد الأهداف بدقة ومن ثمَّ التعامل معها؛ الأمر الذي جعل في استطاعة الدول المالكة لتلك القوة التكنولوجية الذكية خوض حرب شاملة دون أدنى تحرك بشري عسكري على الأرض، مما جعل الذكاء الاصطناعي بمثابة أكبر ثورة رقمية في مجال الشئون العسكرية، الأمر الذي يستلزم إيجاد قواعد قانونية دولية تحمي المسئولية الدولية عن استخدام الذكاء الاصطناعي في الأعمال العسكرية؛ وهو ما سنتناوله من خلال موضوع البحث وعنوانه " المسئولية الدولية عن استخدام الذكاء الاصطناعي (AI) في المجال العسكري " حيث نستهل البحث بالتطرق لمفهوم الذكاء الاصطناعي والطبيعة القانونية له وتطبيقاته في المجال العسكري وماهية المسئولية الدولية الناشئة عنه وصولاً إلى تحليل الجهود الدولية الرامية نحو تقنين استخدام الذكاء الاصطناعي في المجال العسكري سلمًا أو حربًا، مختتمين بمجموعة من النتائج والتوصيات. We are witnessing rapid technological advances that are enabling machines to replace humans in performing many tasks and functions, due to their superior ability to store and process data and analyze information, which makes them capable of making decisions with an efficiency that may surpass that of humans. Despite the advantages of this smart technology, it is in fact a double-edged sword that carries many risks, especially when used in weaponry and warfare. Artificial intelligence has not only succeeded in changing the form of traditional weapons, but has also changed the concept of traditional warfare to electronic warfare, especially after the invention of combat robots and autonomous weapons that have the ability to accurately identify targets and then deal with them. This has enabled countries possessing this intelligent technological power to wage total war without the slightest human military movement on the ground, making artificial intelligence the greatest digital revolution in the field of military affairs. This necessitates the creation of international legal rules that protect international responsibility for the use of artificial intelligence in military operations. This is what we will address in this research paper entitled "International Responsibility for the Use of Artificial Intelligence (AI) in the Military Field." We begin by addressing the concept of artificial intelligence, its legal nature, its applications in the military sphere, and the international responsibility arising from it, before analyzing international efforts aimed at regulating the use of artificial intelligence in the military sphere, whether in peace or war, and concluding with a set of findings and recommendations.
