Abstract

This research addresses the issue of women assuming judicial positions in light of the apparent contradiction between certain jurisprudential trends in Islamic law and the explicit provisions of positive law, using Iraq as a case study. The research aims to clarify the legal and religious basis for women's right to serve as judges and to analyze the reasons for their limited participation in the judiciary, particularly in senior judicial positions, despite the absence of any explicit legal prohibition. The study adopted an analytical and comparative approach, examining Iraqi legislation governing the judiciary and comparing it with legal experiences in other Arab, Islamic, and foreign countries. It also reviewed various Islamic legal perspectives on women serving as judges. The research concluded that while current Iraqi laws do not stipulate male eligibility for judicial appointments, they lack effective mechanisms to ensure balanced representation of women within the judicial system. Furthermore, the study indicated that the jurisprudential disagreement on this issue is a matter of scholarly interpretation, and that Islamic legal texts contain no definitive evidence prohibiting women from serving as judges. The research concluded that the limited presence of women in the judiciary is due to practical, political and institutional obstacles more than legislative or legal ones, and it emphasizes the need to adopt legal and institutional reforms that promote the principles of justice and equality and support women’s effective judicial participation.
