Abstract

Public international law constitutes the regulatory and substantive framework upon which the international community bases its foundations and consolidates its fundamental principles. Due to the rapid transformations in the structure of international relations, many traditional legal concepts have undergone review and modification to keep pace with current challenges. Perhaps the most prominent of these transformations are those witnessed in the concept of "armed conflict" and the principle of "prohibition of the use of force," both of which have been directly affected by the technological revolution in military industries. Military arsenals have shifted from conventional means to a new generation of lethal weapons, ranging from nuclear, chemical, and biological weapons to autonomous weapons systems that rely on artificial intelligence.Furthermore, the problem of using unconventional weapons during armed conflicts is not limited to the nature of the weapon itself, but extends to the extent to which the combatant can control the resulting effects. Fundamental principles such as distinction, proportionality, and military necessity impose strict limitations on any technology that could lead to unjustified suffering or long-term environmental damage. International practice confirms that the absence of an explicit prohibition on a particular weapon does not necessarily legitimize it; rather, it remains governed by the Martens Doctrine, which stipulates that "new weapons fall under the umbrella of humanitarian principles and the dictates of public conscience.
