Abstract

This study presents a comparative jurisprudential analysis of the impact of anger on criminal responsibility, using the case of a husband provoked upon catching his wife in the act of adultery as a model. Through an in-depth legal and jurisprudential examination, the research begins with a conceptual framework that defines anger, its degrees, and its effect on a person’s legal capacity and discernment. It then discusses the concept of being caught in the act of adultery and the psychological impact of sudden confrontation on the husband, which is considered one of the key triggers for impulsive acts, including homicide. The study proceeds to explore the Islamic jurisprudential views on a husband killing his wife or her partner during the act. Jurists are divided: some classify it as intentional murder warranting retribution (qiṣāṣ), while others mitigate the ruling, considering it quasi-intentional or falling under doubt due to extreme provocation, thus not warranting retribution. The study further outlines the conditions under which criminal responsibility may be lifted or mitigated in Islamic law, particularly in cases involving protection of honor and sudden emotional shock. From the perspective of Egyptian criminal law, the study examines Article 237 of the Penal Code, which grants the husband a mitigating legal excuse when killing his wife caught in adultery. The research analyzes the legislator’s rationale in honor-related crimes and the grounds for leniency. It concludes with a critical legal analysis based on principles of justice and equality, calling for the extension of this legal excuse to include wives in similar situations, and for a balanced legal approach that protects human dignity without gender discrimination.
