شركة المحاصة في الفقه الإسلامي وقانون الشركات الكويتي دراسة مقارنة

يتناول هذا البحث موضوع شركة المحاصة في الفقه الإسلامي وقانون الشركات الكويتي، وذلك من خلال بيان معنى شركة المحاصة، وما يتعلق بها بين الفقه الإسلامي وقانون الشركات الكويتي. وقد جاءت هذه الدراسة في مبحثين: جاء المبحث الأول في الحديث عن مفهوم شركة المحاصة، وخصائصها، والتكييف الفقهي لها من خلال ذكر اختلاف الفقهاء المعاصرين فيها، وجاء المبحث الثاني: للحديث عن شركة المحاصة بين قانون الشركات الكويتي والفقه الإسلامي من حيث بيان طبيعة الاستتار القانوني، وما أغفله قانون الشركات الكويتي من تحديد طبيعة عمل شركة المحاصة، وأحكام رأس المال. This research deals with the subject of the joint venture company in Islamic jurisprudence and Kuwaiti companies law, by explaining the meaning of the joint venture company and what is related to it between Islamic jurisprudence and Kuwaiti companies law. This study is divided into two sections: The first section discusses the concept of a joint venture company, its characteristics, and its legal classification by mentioning the differences among contemporary jurists regarding it. The second section discusses the joint venture company between Kuwaiti Companies Law and Islamic jurisprudence in terms of clarifying the nature of legal concealment, and what Kuwaiti Companies Law neglected to define the nature of the joint venture company’s work, and the provisions of capital.
